FORMER LOS ANGELES DA DEFENDS UNDERCOVER PLANNED PARENTHOOD VIDEOMAKER, ACCUSES CA ATTORNEY GENERAL OF POLITICAL WITCH HUNT
LOS ANGELES, May 25—Steve Cooley and Associates (SCA), former Los Angeles County District Attorney Steve Cooley and former Los Angeles County Deputy District Attorney Brentford J. Ferreira, are proud to announce their defense of citizen journalist David Daleiden against the grossly politically-motivated prosecution from the California Attorney General’s office. Daleiden is responsible for the undercover videos of Planned Parenthood senior-level leaders callously negotiating the harvesting and sale of body parts from late-term aborted fetuses.

Daleiden came to SCA immediately after agents of the California Attorney General’s Office served a search warrant at his home and confiscated all his computers, hard drives, and electronic documents—his young life’s entire work-product—in April 2016.
“Then-Attorney General, now U.S. Senator Kamala Harris, wielded unprecedented police power against a true American journalist while civil suits were already pending in Federal District Court concerning the same video-recordings,” says Steve Cooley. “Public Records Act requests filed by SCA reveal the Attorney General’s real interest in this case is entirely political, meant to manipulate the law to do the bidding of their benefactors at Planned Parenthood.”
Daleiden’s work exposed the most infamous and disturbing story of unethical and illegal medical practices since the Tuskegee Institute scandal-the harvesting and sale for profit of fetal organs, tissues and limbs from late term aborted fetuses. When his videos hit the internet, the public outrage prompted congressional hearings and calls for the federal defunding of Planned Parenthood.
After obtaining a preliminary injunction in a civil suit (currently on appeal) against the release of Daleiden’s videos from abortion trade shows, the National Abortion Federation (NAF) and its partner Planned Parenthood importuned the Attorney General to initiate a criminal investigation in order to further suppress Daleiden’s undercover journalism.
On March 28, 2017, the new California Attorney General, Xavier Becerra, announced a criminal complaint charging David and co-defendant Sandra Merritt with 14 felony counts of illegally recording “confidential communications” under California’s anti-eavesdropping law, Penal Code section 632, and a 15th count of conspiracy to violate section 632.
“Every video recording for which the Attorney General is charging David was obviously and unquestionably made in a public place where it could not possibly be considered ‘confidential,’” says Brent Ferreira. “The only difference between David’s conduct and that of undercover video journalists every day in the state of California is the fact that he recorded the political backers of the state’s top prosecutor.”
Although Daleiden and Merritt were very publicly accused of committing 15 felonies, their accusers were listed in the complaint anonymously as Does 1 through 14. An SCA request for the names of the Does was ignored and SCA filed a demurrer to the Complaint on May 3, 2017, at the time set for arraignment.
On May 9, 2017, after the demurrer was filed, the Attorney General sent SCA a password-protected list of Does 1 through 14, stating that the names were somehow confidential, rather than amending the publicly filed complaint to publicly list David’s accusers. There is no protective order in place in state court that would protect the names of the Does, and David is entitled to a public defense.
“The First Amendment must apply equally whether you are pro-choice or pro-life,” says Brent Ferreira, who wrote and filed the demurrer, “and a publicly-accused defendant is entitled to face his accusers in a public trial. Anything less is a corrupt attempt by the Attorney General to orchestrate a star-chamber proceeding reminiscent of the witch hunts and show trials of more unenlightened eras.”
