David Daleiden – Breaking News



LOS ANGELES, May 25—Steve Cooley and Associates (SCA), former Los Angeles County District Attorney Steve Cooley and former Los Angeles County Deputy District Attorney Brentford J. Ferreira, are proud to announce their defense of citizen journalist David Daleiden against the grossly politically-motivated prosecution from the California Attorney General’s office. Daleiden is responsible for the undercover videos of Planned Parenthood senior-level leaders callously negotiating the harvesting and sale of body parts from late-term aborted fetuses.

The Media page features links to all filings in the case thus far, including the Attorney General’s criminal complaint, Defense Counsel’s motionsexhibits, and the all the video footage referenced by the Attorney General’s office in the case.

Daleiden came to SCA immediately after agents of the California Attorney General’s Office served a search warrant at his home and confiscated all his computers, hard drives, and electronic documents—his young life’s entire work-product—in April 2016.

“Then-Attorney General, now U.S. Senator Kamala Harris, wielded unprecedented police power against a true American journalist while civil suits were already pending in Federal District Court concerning the same video-recordings,” says Steve Cooley. “Public Records Act requests filed by SCA reveal the Attorney General’s real interest in this case is entirely political, meant to manipulate the law to do the bidding of their benefactors at Planned Parenthood.”

Daleiden’s work exposed the most infamous and disturbing story of unethical and illegal medical practices since the Tuskegee Institute scandal-the harvesting and sale for profit of fetal organs, tissues and limbs from late term aborted fetuses. When his videos hit the internet, the public outrage prompted congressional hearings and calls for the federal defunding of Planned Parenthood.

After obtaining a preliminary injunction in a civil suit (currently on appeal) against the release of Daleiden’s videos from abortion trade shows, the National Abortion Federation (NAF) and its partner Planned Parenthood importuned the Attorney General to initiate a criminal investigation in order to further suppress Daleiden’s undercover journalism.

On March 28, 2017, the new California Attorney General, Xavier Becerra, announced a criminal complaint charging David and co-defendant Sandra Merritt with 14 felony counts of illegally recording “confidential communications” under California’s anti-eavesdropping law, Penal Code section 632, and a 15th count of conspiracy to violate section 632.

“Every video recording for which the Attorney General is charging David was obviously and unquestionably made in a public place where it could not possibly be considered ‘confidential,’” says Brent Ferreira. “The only difference between David’s conduct and that of undercover video journalists every day in the state of California is the fact that he recorded the political backers of the state’s top prosecutor.”

Although Daleiden and Merritt were very publicly accused of committing 15 felonies, their accusers were listed in the complaint anonymously as Does 1 through 14. An SCA request for the names of the Does was ignored and SCA filed a demurrer to the Complaint on May 3, 2017, at the time set for arraignment.

On May 9, 2017, after the demurrer was filed, the Attorney General sent SCA a password-protected list of Does 1 through 14, stating that the names were somehow confidential, rather than amending the publicly filed complaint to publicly list David’s accusers. There is no protective order in place in state court that would protect the names of the Does, and David is entitled to a public defense.

“The First Amendment must apply equally whether you are pro-choice or pro-life,” says Brent Ferreira, who wrote and filed the demurrer, “and a publicly-accused defendant is entitled to face his accusers in a public trial. Anything less is a corrupt attempt by the Attorney General to orchestrate a star-chamber proceeding reminiscent of the witch hunts and show trials of more unenlightened eras.”

DOE 2 – Dr. Stephen Hindes, owner of “Healthy Futures for Women” and former abortion provider for Planned Parenthood Rocky Mountains

DOE 3 – Dr. Susan Robinson, third-trimester abortion doctor at Southwestern Women’s Options and abortion provider for Planned Parenthood Mar Monte

DOE 4 – Ms. Amy Hagstrom Miller, CEO of “Whole Woman’s Health”

DOE 5 – Dr. Lisa Harris, Medical Director of Planned Parenthood of Michigan

DOE 6 – Dr. Mathew Reeves, Medical Director of the National Abortion Federation and abortion provider for Planned Parenthood Metropolitan Washington, D.C.

DOE 7 – Ms. Debbie Bamberger, non-physician surgical abortion provider for Planned Parenthood Northern California

DOE 8 – Dr. Norma Jo Waxman, abortion professor at taxpayer-funded UC San Francisco

5-26-17 Update on the content of the videos: U.S. District Judge William Orrick ordered the videos to be taken down. Further, he ordered David Daleiden and his attorneys, Steve Cooley and Brentford J. Ferreira, to appear at a June 14 hearing to consider contempt sanctions. You can read more about it here.   3. Wonderful to hear that David is receiving support and backing from an attorney who knows the ins and outs of the CAG’s office. Let’s hope and pray that this case starts to get some of the publicity that it deserves.

      Yes, docdave777! Most of the time, good Christians like David who get set upon by the great and massive engines of “Caesar,” (the State), are ground to a pulp both emotionally and financially. (All at taxpayers’ expense!) Regrettably, often they choose legal counsel who are neither a “first-string team,” have little political clout, nor do they know “the ropes” and snares of the media.

      I’m enthralled that David has a “World Class Legal Team” on board with him! They known their stuff! As a retired lawyer myself, I have two words for David’s legal team: “Sic ’em!”

      Cry ‘Havoc,’ and let slip the attack dogs of legal war. Let no truth be a prisoner!

  6. Certainly David and his team are true hero warriors of the Pro-Life Movement! Such great news! I saw awhile back on Fox News,video clips concerning this case. They were
    absolutely just sickening! I pray that the efforts of these also brave people who have come to David and his team’s aid will be successful and be able to clear all of their names and will help to prevent future misuse of the court system. Betty

    Seems as if the videos were deleted. For what it is worth, we know morality has been flushed from much of worldly society and that through prayer it can/will be restored one person at a time. Our Heavenly Father and Mother must have heavy hearts because of all the lost children in the world.

    Thank you Blessed Mother for interceding for David and Sandra. As JoyInTheLord stated above “I think it (the Triumph) has begun”. Have we ever imagined just how this Triumph will play out? I think it is time to start cataloguing the incremental steps, both personally and on the grander scale. For me the great marker will be the papal announcement of the Fifth Marian Dogma of Mother as CoRedemptrix, Mediatrix and Advocate. Then we will watch, or take part in, the flowering of that Dogma for the Glory of God. Fiat! Amen!

You can go to the Thomas More Society web page and click onto the David Daleiden Defense Fund. It allows supporters to contribute to their legal defense fund. Small donations add up to defray large legal costs. The Thomas More Society functions in the name of Saint Thomas More to defend illegally and falsely accused persons. Every little bit helps.

          Hi Doug, no I wasn’t in fact, but it’s sorely needed as colleges north and south are hotbeds of leftism – and that’s only the faculty 😛 Although what was amazing was that the pro-life side recently won a debate in University College Cork – the madness of safe spaces and banning hasn’t quite taken on here… yet. But I’m sure they’re working on that.

        Lord, jaykay, I know I am stuck in the past somewhat. My grandmother was born in Ireland and was from Tuam, Galway. She would be appalled. It breaks my heart that Ireland is following in our footpath. I wonder what happened to Knock. It feels like the country is abandoning The Faith. Ireland has been so protected by the BVM. Why does it risk losing her protection?

          Hi Joanne, I think the tragedy is that so many in this country have such an inferiority complex (for historical reasons) that they just rush to follow trends that seem cool in the “sophisticated” world. They completely lack the confidence they should have in our rich Catholic heritage, one of the oldest and richest in Europe. It’s the reverse, in fact: they’re ashamed of it and can’t wait to junk it all and try to keep up with the cool kids – not realising that the cool kids still despise them anyway. It’s pathetic to see their cringing and fawning for approval. And thus, they are ashamed of Our Mother, and Ireland’s historical devotion to Her, because that represents (to their deluded minds) all that was “backward” about the “old Ireland”. There will be a price to be paid for this – let’s hope that it’s not eternal. As I remarked above on 26th May, we have to pray for their conversion – and yes, still a massive reminder to self in that regard!

          However, in that regard, and to end on a positive note: I’m setting off tomorrow on the traditional Chartres Pentecost Pilgrimage in France (from Notre Dame in Paris to Notre Dame in Chartres over 2.5 days), with our Irish St. Patrick’s Chapter. It’s under the patronage of Our Lady – Notre Dame. We’ll have a few from the US with us, as ever – not necessarily of Irish descent – and their presence is very welcome.           So a great opportunity over 3 tough, bruising days to offer up the hardships and pray for our grievously misled brothers and sisters, who seem determined to run back to the pagan darkness St. Patrick came to lead us out of.
